How is "fit to act" as a director defined by The Company Directors Disqualification Act 1986?

 

 

The starting point is to realise that under The Company Directors Disqualification Act 1986 there are no shades of grey. Under the  Act  a director is classed either as "fit" or "unfit". By fit is meant that that person is fit to act as a director of a future company.

 

There is no definition of a "fit" director. Instead you have to read a list of all the matters that the Company Directors Disqualification Act 1986 indicate are pointers to "unfitness".   If you are not regarded as "unfit" under those pointers then by definition you are "fit" to act again as a director in future companies.
